Liability Waiver and Release Agreement
I, {name}, understand that participation in fitness activities at Feral Reps Fitness LLC DBA Feral Fitness (“Gym”) involves inherent risks. These activities include, but are not limited to, strength training, cardiovascular exercise, personal training, group classes, use of equipment, and presence on the premises. I acknowledge that such risks include, but are not limited to, muscle strains and tears, sprains, fractures, equipment malfunction, slips, trips, falls, overexertion, heat-related illness, serious bodily injury, permanent disability, and death. I voluntarily and knowingly assume all risks, whether known or unknown, associated with my participation and use of the Gym, including unsupervised and 24/7 access where applicable.
TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS FERAL REPS FITNESS LLC DBA FERAL FITNESS, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, VENDORS, AND AFFILIATES (COLLECTIVELY, “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO MY USE OF THE GYM, ITS EQUIPMENT, SERVICES, OR PREMISES, INCLUDING BUT NOT LIMITED TO CLAIMS FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH, EVEN IF CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASED PARTIES. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, liabilities, costs, and attorney’s fees arising from my actions or omissions, my misuse of equipment, my violation of Gym rules or policies, or any claim brought on my behalf or by a third party related to my conduct. I represent that I am not aware of any medical condition that would prevent me from safely participating in fitness activities and understand that it is my responsibility to consult a physician if necessary prior to participation. I agree to stop exercising immediately if I experience pain, dizziness, or distress. In the event of injury or medical emergency, I authorize Gym staff to contact emergency services, provide basic first aid, and share relevant information with medical providers, and I agree to be financially responsible for any medical treatment received.
I agree to use all equipment as intended, follow all posted rules and staff instructions, not attempt exercises or lifts beyond my capability, and refrain from unsafe or reckless behavior, and I understand that failure to do so increases the risk of serious injury. I understand that all equipment and facilities are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, and I accept responsibility for inspecting equipment prior to use and reporting any issues.
I grant the Gym permission to use photographs or video recordings of me taken on the premises for marketing, promotional, or commercial purposes, in any media, worldwide, and in perpetuity, without compensation.
If the participant is under 18 years old, I certify that I am the parent or legal guardian of the minor, I consent to their participation, I agree to all terms of this Agreement on their behalf, and I agree to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the minor.
I HAVE READ THIS LIABILITY WAIVER AND RELEASE AGREEMENT CAREFULLY. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND I ACCEPT THIS AGREEMENT VOLUNTARILY.
